TERMS OF SALES
These general conditions of sale apply to all orders placed on the site www.lesfilsdisa.fr ,. They are written in French.
Lesfilsdisa® reserves the right to modify these conditions over time. The conditions applicable to any order are those in force at the time of placing the order on the website www.lesfilsdisa.fr.
Any buyer (The customer) on the site www.lesfilsdisa.fr is deemed to have read and accepted in their entirety the general conditions of sale below before validating their order.
-INFORMATION ON THE SITE AND ACCESSIBILITY OF THE SITE:
www.lesfilsdisa.fr is an e-commerce site hosted by Shopify and owned and managed by Isabelle Bertaux Zevaco (IBZ)
The Site is open to all users of the internet network in principle accessible 24 hours a day, 7 days a week, except interruption, scheduled or not, by IBZ or its service providers, for the purposes of its maintenance or case of force majeure (as defined herein). IBZ cannot be held responsible for any damage, whatever its nature, resulting from unavailability of the Site.
IBZ does not guarantee that the Site will be free of anomalies, errors or bugs, nor that the Site will operate without breakdown or interruption. In this regard, it may freely and at its sole discretion determine any period of unavailability of the Site or its content. IBZ cannot be held responsible for data transmission, connection or network unavailability problems.
- REGISTRATION ON THE SITE:
To be able to place an Order, the Customer must first register on the Site by creating an account containing the Customer's information (the "Account").
The Client's registration on the Site is validated by IBZ after verification of the standard form completed by the Client. The Customer receives a registration confirmation email.
When creating their Account, the Customer must ensure the accuracy and completeness of the data they provide. The Customer is required to always update his personal information. In the event of an error in the wording of the recipient's contact details, IBZ cannot be held responsible for the impossibility of delivering Products.
By registering on the Site, the Client declares and guarantees to IBZ that he is of legal age and has the legal capacity to contract.
IBZ may delete the Customer's Account at any time, for any reason, in its sole discretion.
The products offered for sale are those described on the Site on the day of consultation of the Site by the Customer, within the limits of available stocks. These indications are automatically updated in real time. However, an error in the update, whatever its origin, does not engage the responsibility of IBZ.
IBZ takes the greatest care in the presentation and description of these products to best satisfy the Customer's information and strives to present as precisely as possible the colors and images of the products appearing on the store. However, we cannot guarantee the accuracy of the color display on your computer monitor. However, it is possible that errors may appear on the Site, which the Customer acknowledges and accepts.
IBZ reserves the right, but is not obligated, to limit the sale of its products or Services to any given person, geographic region or jurisdiction. IBZ authorizes itself to exercise this right on a case-by-case basis, as well as the right to limit the quantities of products or services that are offered. All product descriptions and pricing are subject to change at any time, without notice and at its sole discretion. IBZ reserves the right to discontinue the sale of a product at any time. Any offer for any product or service on this site is void where prohibited by law.
The prices of the products are indicated on the Site in euros for Europe and all taxes included. (Value added tax not applicable, article 293B of the CGI)
IBZ reserves the right to modify its prices at any time but the products will be invoiced on the basis of the prices in effect at the time the order is registered, subject to availability.
The products are payable in cash at the time of the actual Order.
The prices do not take into account the various delivery costs, which will be offered to the customer at the time of validation of their order.
Delivery to a relay point is free from 80€ of purchase (to mainland France).
- TERMS OF PAYMENT :
Payment for purchases is made by:
- Bank cards via Shopify Payment: Visa, Mastercard, American Express, Apple Pay, Carte Bleue (Payment is secure with PCI DSS certification, encrypted payment data, and 3DSecure payment)
- Paypal : You do not provide your credit card number and payment is immediate without additional costs. (data encrypted by the “Secure Socket Layer” security system (SSL technology)
The Customer expressly acknowledges that the communication of his bank card number when paying constitutes authorization to debit his Account up to the price of the Products ordered. If applicable, a notification of Order cancellation for non-payment is sent to the Customer by IBZ to the email address provided by the Customer when registering on the Site.
The data recorded and kept by IBZ constitutes proof of the Order and all past sales. The data recorded by the payment methods offered constitute proof of any financial transaction between the Client and IBZ.
Deliveries are currently limited to France, Germany, Luxembourg, Belgium, Netherlands, Spain, Portugal and Italy.
After validation, orders are generally shipped within 3 to 5 days currently and in particular according to the date indicated on each product sheet at the time of the order .
Deliveries are made by the services of:
- Post by Colissimo or Tracked Mail for mainland France. The estimated delivery time usually varies from 2 to 4 working days from actual shipment.
- Mondial Relay at collection point. Estimated time is generally 4 business days from shipment.
- Chronopost 2Shop as a relay point for France and other eligible countries. The estimated delivery time from actual shipment in mainland France is 4 working days.
Transport costs are the responsibility of the buyer unless your order reaches the amount of 80 euros (offered at relay points for mainland France).
The buyer can consult the status of their order at any time using the tracking number which will be communicated to them upon shipment. This tracking allows the buyer to know the processing status of their order, but also the shipping status of their packages.
- WITHDRAWAL, REFUNDS AND RETURNS:
Any non-professional consumer has a right of withdrawal regarding their online purchase, with the exception of personalized products which can therefore no longer be resold according to article L 221-18 of the Consumer Code. The use of the right of withdrawal must be reported in advance by email to the following address: firstname.lastname@example.org using the withdrawal form (downloadable) available. In this eventuality, IBZ communicates to the Client an acknowledgment of receipt of his request.
The right of withdrawal is exercised without penalty. If the Customer uses this right, the Product must be returned to IBZ within 14 (fourteen) days (starting on the day the customer communicated their withdrawal). Beyond this period of 14 (fourteen) days, the sale is firm and final.
To be eligible for return, you must return your item within this fourteen day period, with return costs being the responsibility of the buyer.
We advise you to use its original packaging and to ensure that the item is well protected for this return. Any damage to the product may entitle us to only provide a partial refund. Personalized products are neither returned nor exchanged.
Reimbursement is provided provided that IBZ has been able to recover the Products initially delivered. Unless the Customer wishes otherwise, IBZ makes the reimbursement using the same means of payment as that which was used for the transaction.
The return of the Products is the responsibility of the Customer. In the event of loss or damage to the returned package, we will not be able to reimburse the order and the buyer will have to make a claim directly with their carrier.
The return costs are, however, the responsibility of Lesfilsdisa if the Product delivered to the Customer is different from the Product ordered or if it is delivered damaged.
If the Customer fails to comply with these General Terms and Conditions, IBZ will not be able to reimburse the Products concerned.
– Guarantees – Limitation of liability:
Our policy lasts 14 days. If more than 14 days have passed since you received it, we unfortunately cannot offer refunds or exchanges.
We advise you to use its original packaging and to ensure that the item is well protected for this return. Any damage to the product may entitle us to only provide a partial refund.
Once your return is received and inspected, we will email you to let you know that we have received the returned item. We will also let you know if your refund is approved or denied.
If it is approved, your refund is then processed and your credit card or initial means of payment is automatically credited within a few days depending on the banking establishment and you will be informed by email to the address provided. on the site at the time of your purchase.

Shipping costs associated with returning your item are your responsibility. They are not refundable. It is up to you to choose a tracked shipping service or to insure your shipment according to its value which will circulate under your responsibility until its receipt by Lesfilsdisa.
In accordance with articles L.616-1 and R.616-1 of the Consumer Code, our company has set up a consumer mediation system. The mediation entity selected is: CNPM - MEDIATION - CONSUMPTION. - Apparent defect:
The presence of an apparent defect on a Product must give rise to a complaint by email to the address: email@example.com within three working days following Delivery. Any complaint must explain the defect concerned. Otherwise, no complaint is admissible, and no return or exchange is possible. The Product must be returned, in its original packaging, in its original condition, new, unworn, unwashed, with the references of the initial Order and a copy of the complaint after sending an e-mail notifying the apparent defect of the Product referred to above. Cases of apparent defect confirmed by IBZ give rise, depending on the content of the Customer's complaint, either to the establishment of a credit for the benefit of the Customer, or to the replacement of the Product, or to the pure and simple reimbursement of the Price to the Customer in a 14 day deadline. In the event of non-compliance with the return procedure, no exchange or refund or credit is possible.
-Non-compliance – Hidden defects:
Subject to validation of non-conformity or a hidden defect by IBZ or the manufacturer as the case may be, the Customer benefits from the following guarantees:
– the legal guarantee of conformity which allows it to obtain, within two years of delivery of the Product and free of charge, the repair or replacement of it if it does not conform to the Order. This guarantee covers defects in the conformity of the Product and the packaging. IBZ may replace the non-compliant Product. If replacement is impossible within one month following the complaint or if the Customer makes a reasoned request, the Customer may request reimbursement of the price of the Product.
– the legal guarantee against hidden defects, under which the Customer can request, within two years from the discovery of the defect, the reimbursement of a Product which turns out to be unfit for its use.
The hidden defects guarantee allows the Customer to be protected against hidden defects in the Product purchased and which prevent its use or affect it to such an extent that the Customer would not have purchased it. The Customer then has the choice between two options: keep the Product and request a reduction in the price, or return the Product and request a refund of the price paid.
In order to implement these guarantees, the Product must be returned, in its original packaging, in its original condition, new, unworn, unwashed, using the references of the initial Order and copy of the complaint to IBZ, after sending an email to firstname.lastname@example.org indicating the reason for returning the Product.
For all purposes, the following legal provisions are recalled:
Art. L. 211-4 of the Consumer Code: “The seller is required to deliver goods in conformity with the contract and is liable for any lack of conformity existing at the time of delivery. He is also liable for defects in conformity resulting from the packaging, assembly instructions or installation when this has been his responsibility by the contract or has been carried out under his responsibility. »
Art. L. 211-5 of the Consumer Code: “To comply with the contract, the good must: 1° Be suitable for the use usually expected of a similar good and, where applicable: a) correspond to the description given by the seller and possess the qualities that the latter presented to the Customer in the form of a sample or model; b) present the qualities that a Customer can legitimately expect having regard to the public declarations made by the seller, by the producer or by his representative, in particular in advertising or labeling. 2° Or present the characteristics defined by mutual agreement by the parties or be suitable for any special use sought by the customer, brought to the attention of the seller and which the latter has accepted. »
Art. L. 211-7 of the Consumer Code: “Defects of conformity which appear within six months of delivery of the good are presumed to exist at the time of delivery, unless proven otherwise. The seller can combat this presumption if it is not compatible with the nature of the goods or the alleged lack of conformity. »
Art. L. 211-7 of the Consumer Code: “If repair and replacement of the goods are impossible, the buyer can return the goods and have the price refunded or keep the goods and have part of the price refunded. The same faculty is open to him:
1° If the solution requested, proposed or agreed pursuant to article L. 211-9 cannot be implemented within one month following the buyer's complaint;
2° Or if this solution cannot be done without major inconvenience for him taking into account the nature of the property and the use he is seeking. However, the sale cannot be canceled if the lack of conformity is minor. »
Art. L. 211-12. of the Consumer Code: “The action resulting from the lack of conformity is prescribed two years from the delivery of the good. »
Art. 1641 of the Civil Code: “The seller is bound by the guarantee for hidden defects in the thing sold which make it unfit for the use for which it is intended, or which reduce this use to such an extent that the Customer would not have it acquired, or would have given only a lower price, if he had known them. »
Art. 1648 paragraph 1 of the Civil Code: “The action resulting from redhibitory defects must be brought by the purchaser within two years from the discovery of the defect. »
