PREAMBLE:

These general terms and conditions of sale apply to all orders placed on the website www.lesfilsdisa.fr . They are written in French.

Lesfilsdisa® reserves the right to modify these conditions over time. The conditions applicable to any order are those in force at the time the order is placed on the www.lesfilsdisa.fr website.

Any buyer (the customer) on the www.lesfilsdisa.fr website is deemed to have read and fully accepted the general terms and conditions of sale below before validating their order.

 

-INFORMATION ON THE SITE AND SITE ACCESSIBILITY:

www.lesfilsdisa.fr is an e-commerce site hosted by Shopify and owned and managed by Isabelle Bertaux Zevaco (IBZ)

The Site is open to all internet network users, in principle accessible 24/7, except for interruptions, scheduled or not, by IBZ or its service providers, for maintenance needs or in cases of force majeure (as defined herein). IBZ cannot be held responsible for any damage, of whatever nature, resulting from the unavailability of the Site.

IBZ does not guarantee that the Site will be free of anomalies, errors or bugs, nor that the Site will operate without breakdown or interruption. In this respect, it may freely and at its sole discretion determine any period of unavailability of the Site or its content. IBZ can no longer be held responsible for data transmission, connection or network unavailability issues.

 

- SITE REGISTRATION:

To place an Order, the Customer must first register on the Site by creating an account containing the Customer's information (the "Account").

The Customer's registration on the Site is validated by IBZ after verification of the standard form completed by the Customer. The Customer receives a registration confirmation email.

When creating their Account, the Customer must ensure the accuracy and completeness of the data they provide. The Customer is required to always update their personal information. In the event of an error in the recipient's contact details, IBZ cannot be held responsible for the impossibility of delivering Products.

By registering on the Site, the Customer declares and guarantees to IBZ that they are of legal age and have the legal capacity to contract.

IBZ may delete the Customer's Account at any time, for any reason, at its sole discretion.

 

-PRODUCTS:

The products offered for sale are those described on the Site on the day of the Customer's consultation of the Site, within the limits of available stock. These indications are updated automatically in real time. However, an error in updating, whatever its origin, does not engage IBZ's responsibility.

IBZ takes the greatest care in the presentation and description of these products to best satisfy the Customer's information and strives to present the colors and images of the products on the store as accurately as possible. However, we cannot guarantee the accuracy of the color display on your computer screen. It is nevertheless possible that errors may appear on the Site, which the Customer acknowledges and accepts.

IBZ reserves the right, without being obliged to do so, to limit the sale of its products or Services to any person, geographical region or given jurisdiction. IBZ authorizes itself to exercise this right on a case-by-case basis, as well as the right to limit the quantities of products or services offered. All product descriptions and pricing are subject to change at any time, without notice and at its sole discretion. IBZ reserves the right to discontinue the sale of a product at any time. Any offer of product or service on this site is void where prohibited by law.

-PRICES:

The prices of the products are indicated on the Site in euros for Europe and all taxes included. (Value added tax not applicable, article 293B of the CGI)

IBZ reserves the right to modify its prices at any time, but products will be invoiced on the basis of the rates in force at the time the order is registered, subject to availability.

Products are payable in cash at the time of the effective Order.

Prices do not include the various delivery costs, which will be offered to the customer at the time of validating their order.

Relay point delivery is free for purchases over €80 (to mainland France).

 

- PAYMENT METHODS:

Purchases can be paid for by:

- Bank cards via Shopify Payment: Visa, Mastercard, American Express, Apple Pay, Carte Bleue (Payment is secure with PCI DSS certification, encrypted payment data, and 3DSecure payment)

- Paypal: You do not communicate your credit card number and payment is immediate without additional fees. (data encrypted by the "Secure Socket Layer" security system (SSL technology))

 

The Client expressly acknowledges that the communication of their credit card number during payment constitutes authorization to debit their Account for the price of the Products ordered. If applicable, a cancellation notification of the Order for non-payment is sent to the Client by IBZ to the email address provided by the Client when registering on the Site.

The data recorded and stored by IBZ constitute proof of the order and all sales made. The data recorded by the proposed payment methods constitute proof of any financial transaction between the Client and IBZ.

 

- DELIVERIES:

Deliveries are currently limited to France, Germany, Luxembourg, Belgium, Netherlands, Spain, Portugal and Italy and other authorized European countries.

After validation, orders are generally shipped within 3 to 5 days currently and especially according to the date indicated on each product sheet at the time of ordering .

Deliveries are carried out by the services of:

- La Poste with Colissimo or Tracked Mail for metropolitan France. The delivery time usually varies from 2 to 4 working days from actual shipment.

-Mondial Relay to a pick-up point. The delay is generally 4 working days from shipment.

- By Delivengo via La Poste for authorized international shipments (to Europe). The delay varies depending on the destination country.

Shipping costs are borne by the buyer unless your order reaches the amount of 80 euros (offer in a relay point for mainland France).

The buyer can at any time consult the status of their order thanks to the tracking number that will be communicated to them upon dispatch. This tracking allows the buyer to know the processing status of their order, as well as the shipping status of their packages.

 

-CANCELLATION, REFUNDS AND RETURNS:

Any non-professional consumer has a right of withdrawal regarding their online purchase, with the exception of personalized products which therefore cannot be resold according to article L 221-18 of the Consumer Code. The exercise of the right of withdrawal must be notified in advance by email to the following address: contact@lesfilsdisa.fr using the withdrawal form (downloadable) available. In this event, IBZ sends the Customer an acknowledgment of receipt of their request.

The right of withdrawal is exercised without penalty. In case of exercise of this right by the Client, the Product must be returned to IBZ within 14 (fourteen) days (starting from the day the client communicated their withdrawal). Beyond this period of 14 (fourteen) days, the sale is firm and final.

To be returned, you must send your item back within this fourteen-day period, with return shipping costs at the buyer's expense.

We advise you to use its original packaging and to carefully protect the item for this return. Any damage suffered by the product may entitle us to process only a partial refund. Personalized products are neither returned nor exchanged.

The refund is subject to IBZ being able to recover the Products initially delivered. Unless the Customer wishes otherwise, IBZ will issue the refund using the same payment method that was used for the transaction.

The return of Products is at the Customer's expense. In case of loss or damage to the returned package, we will not be able to refund the order and the buyer will have to file a claim directly with their carrier.

Return costs are borne by Lesfilsdisa if the Product delivered to the Customer is different from the Product ordered or if it is delivered damaged.

In case of non-compliance by the Client with these GTC, IBZ will not be able to refund the Products concerned.

 

– Warranties – Limitation of Liability:

Our policy lasts 14 days. If more than 14 days have passed since your receipt, we unfortunately cannot offer a refund or exchange.

We advise you to use its original packaging and to carefully protect the item for this return. Any damage suffered by the product may entitle us to process only a partial refund.

Once your return is received and inspected, we will send you an email to notify you that we have received your returned item. We will also inform you whether your refund is approved or denied.

If approved, your refund is then processed and your credit card or original payment method is automatically credited within a few days depending on the banking establishments and you will be informed by email at the address provided on the site at the time of your purchase.

 

-Return Shipping:

To return your product, you must send it to the following postal address:

The shipping costs for returning your item are at your expense. They are non-refundable. It is up to you to choose a tracked shipping service or to insure your shipment according to its value, which will travel under your responsibility until it is received by Lesfilsdisa.

 -Mediation:

In accordance with articles L.616-1 and R.616-1 of the Consumer Code, our company has implemented a consumer mediation system. The chosen mediation entity is: CNPM - MEDIATION - CONSOMMATION.  -Apparent Defect:

The presence of an apparent defect on a Product must give rise to a claim by email to: contact@lesfilsdisa.fr within three working days following delivery. Any claim must specify the defect concerned. Otherwise, no claim will be admissible, and no return or exchange will be possible. The Product must be returned, in its original packaging, in its original condition, new, unworn, unwashed, with the references of the initial Order and a copy of the claim after sending an email reporting the apparent defect of the Product referred to above. Cases of apparent defect confirmed by IBZ will, depending on the content of the Customer's claim, lead either to the issuance of a credit note to the Customer, or to the replacement of the Product, or to a simple refund of the Price to the Customer within 14 days. In case of non-compliance with the return procedure, no exchange or refund is possible.

 

-Non-conformity – Hidden defects:

Subject to validation of non-conformity or a hidden defect by IBZ or the manufacturer as appropriate, the Customer benefits from the following guarantees:

– the legal guarantee of conformity which allows them to obtain, within two years of delivery of the Product and without charge, its repair or replacement if it is not compliant with the Order. This guarantee covers defects in the conformity of the Product and its packaging. IBZ may replace the non-compliant Product. If replacement is impossible within one month following the claim or if the Customer makes a reasoned request for it, the Customer may request a refund of the Product price.

– the legal guarantee against hidden defects, by virtue of which the Customer may request, within two years from the discovery of the defect, a refund for a Product that proves unfit for its intended use.

The hidden defects warranty protects the Customer against hidden defects of the purchased Product that prevent its use or affect it to such an extent that the Customer would not have bought it. The Customer then has the choice between two options: keep the Product and ask for a price reduction, or return the Product and ask for a refund of the price paid.

In order to implement these guarantees, the Product must be returned, in its original packaging, in its original condition, new, unworn, unwashed, using the references of the initial Order and a copy of the claim to IBZ, after sending an email to contact@lesfilsdisa.fr stating the reason for the return of the Product.

 

For all intents and purposes, the following legal provisions are recalled:

 

Art. L. 211-4 of the Consumer Code: "The seller is obliged to deliver goods in conformity with the contract and is liable for any defects in conformity existing at the time of delivery. They are also liable for defects in conformity resulting from the packaging, assembly instructions or installation when this was their responsibility under the contract or was carried out under their responsibility."

 

Art. L. 211-5 of the Consumer Code: "To be in conformity with the contract, the goods must: 1° Be fit for the purpose usually expected of similar goods and, where applicable: a) correspond to the description given by the seller and possess the qualities that the latter presented to the Customer in the form of a sample or model; b) present the qualities that a Customer can legitimately expect given the public declarations made by the seller, by the producer or by their representative, particularly in advertising or labeling. 2° Or present the characteristics defined by mutual agreement between the parties or be fit for any special use sought by the customer, brought to the attention of the seller and accepted by the latter."

 

Art. L. 211-7 of the Consumer Code: "Defects of conformity that appear within six months of the delivery of the goods are presumed to exist at the time of delivery, unless proven otherwise. The seller can challenge this presumption if it is not compatible with the nature of the goods or the alleged lack of conformity."

 

Art. L. 211-7 of the Consumer Code: "If the repair and replacement of the goods are impossible, the buyer can return the goods and get a refund of the price or keep the goods and get a partial refund of the price. The same faculty is open to him:

 

1° If the requested, proposed or agreed solution under Article L. 211-9 cannot be implemented within one month following the buyer's claim;

 

2° Or if this solution cannot be achieved without major inconvenience for the latter, considering the nature of the goods and the use he seeks. However, the sale cannot be rescinded if the lack of conformity is minor. »

 

Art. L. 211-12 of the Consumer Code: "The action resulting from the lack of conformity is prescribed by two years from the delivery of the goods."

 

Art. 1641 of the Civil Code: "The seller is bound by a warranty against hidden defects of the thing sold which render it unfit for the purpose for which it was intended, or which so diminish this use, that the Customer would not have acquired it, or would only have given a lesser price, had they known about them."

 

Art. 1648 paragraph 1 of the Civil Code: "The action resulting from redhibitory defects must be brought by the buyer within two years from the discovery of the defect."

 -Intellectual Property:

Any reproduction or unauthorized use of the texts, comments and photographs used on the website www.lesfilsdisa.fr is strictly prohibited.

 -VAT:
