TERMS OF SALES
These general terms and conditions of sale apply to all orders placed on the www.lesfilsdisa.fr website. They are written in French.
Lesfilsdisa® reserves the right to modify these conditions over time. The conditions applicable to all orders are those in force at the time the order is placed on the www.lesfilsdisa.fr website.
Any buyer (the customer) on the site www.lesfilsdisa.fr is deemed to have read and accepted in full the general conditions of sale below before validating their order.
-SITE INFORMATION AND SITE ACCESSIBILITY:
www.lesfilsdisa.fr is an e-commerce site hosted by Shopify and owned and managed by Isabelle Bertaux Zevaco (IBZ)
The Site is open to all users of the Internet network, in principle accessible 24 hours a day, 7 days a week, except for interruption, scheduled or not, by IBZ or its service providers, for the purposes of its maintenance or in the event of force majeure (as defined herein). IBZ cannot be held responsible for any damage, whatever its nature, resulting from the unavailability of the Site.
IBZ does not warrant that the Site will be free from anomalies, errors or bugs, or that the Site will operate without failure or interruption. In this regard, he may freely and at his entire discretion determine any period of unavailability of the Site or its content. IBZ also cannot be held responsible for problems with data transmission, connection or network unavailability.
- REGISTRATION ON THE SITE:
To be able to place an Order, the Customer must first register on the Site by creating an account containing the Customer's information (the "Account").
The Client's registration on the Site is validated by IBZ after verification of the standard form completed by the Client. The Customer receives a registration confirmation email.
When creating his Account, the Customer must ensure the accuracy and completeness of the data he provides. The Customer is required to always update his personal information. In the event of an error in the wording of the recipient's contact details, IBZ cannot be held responsible for the impossibility of delivering the Products.
By registering on the Site, the Client declares and guarantees to IBZ that he is of legal age and has the legal capacity to contract.
IBZ may delete Customer's Account at any time, for any reason, in its sole discretion.
The products offered for sale are those described on the Site on the day the Customer consults the Site, within the limits of available stocks. These indications are updated automatically in real time. However, an error in the update, whatever its origin, does not engage the responsibility of IBZ.
IBZ takes the greatest care in the presentation and description of these products to best satisfy the information of the Customer and endeavors to present as precisely as possible the colors and images of the products appearing on the store. However, we cannot guarantee the accuracy of the display of colors on your computer screen. However, it is possible that errors may appear on the Site, which the Customer acknowledges and accepts.
IBZ reserves the right, but is not obligated, to limit the sale of its products or Services to any particular person, geographic region or jurisdiction. IBZ is authorized to exercise this right on a case-by-case basis, as well as the right to limit the quantities of the products or services that are offered. All product descriptions and pricing are subject to change at any time, without notice and at its sole discretion. IBZ reserves the right to discontinue the sale of a product at any time. Any product or service offer on this site is void where prohibited by law.
The prices of the products are indicated on the Site in euros for Europe and all taxes included. (Value added tax not applicable, article 293B of the CGI)
IBZ reserves the right to modify its prices at any time, but the products will be invoiced on the basis of the prices in force at the time the order is recorded, subject to availability.
The products are payable in cash when the actual Order is placed.
The prices do not take into account the various delivery costs, which will be offered to the customer at the time of validation of his order.
Delivery to a relay point is free from purchases of €80 (to mainland France).
- TERMS OF PAYMENT:
Payment for purchases is made by:
- Bank cards via Shopify Payment: Visa, Mastercard, American Express, Apple Pay, Carte Bleue (Payment is secure with PCI DSS certification, encrypted payment data, and 3DSecure payment)
- Paypal : You do not communicate your credit card number and the payment is immediate without additional costs. (data encrypted by the “Secure Socket Layer” security system (SSL technology)
The Customer expressly acknowledges that the communication of his bank card number during his payment constitutes authorization to debit his Account up to the price of the Products ordered. If necessary, a notification of cancellation of Order for non-payment is sent to the Customer by IBZ on the email address communicated by the Customer when registering on the Site.
The data recorded and kept by IBZ constitutes proof of the Order and of all past sales. The data recorded by the means of payment offered constitutes proof of any financial transaction between the Client and IBZ.
Deliveries are currently limited to France, Germany, Luxembourg, Belgium, Netherlands, Spain, Portugal and Italy.
After their validation, orders are generally shipped within 3 to 5 days currently and in particular according to the date indicated on each product sheet at the time of the order .
Deliveries are made by the services of:
- La Poste by Colissimo or Courrier Suivi for mainland France. The estimated delivery time varies from 2 to 4 working days usually from the actual shipment.
- Chronopost 2Shop as a relay point for France and other eligible countries. The estimated delivery time from the actual shipment in metropolitan France is 4 working days.
Transport costs are the responsibility of the buyer unless your order reaches the amount of 80 euros (offered at a relay point for metropolitan France).
The buyer can at any time consult the status of his order thanks to the tracking number which will be communicated to him during the shipment. This follow-up allows the buyer to know the processing status of his order, but also the shipping status of his packages.
- WITHDRAWAL, REFUNDS AND RETURNS:
Any non-professional consumer has a right of withdrawal concerning his online purchase, with the exception of personalized products which can therefore no longer be resold according to article L 221-18 of the Consumer Code. The use of the right of withdrawal must be notified in advance by email to the following address: email@example.com using the withdrawal form (downloadable) available. In this event, IBz communicates to the Client an acknowledgment of receipt of his request.
The right of withdrawal is exercised without penalty. In the event of use of this right by the Customer, the Product must be returned to IBZ within 14 (fourteen) days (beginning on the day of receipt of the Products). Beyond this period of 14 (fourteen) days, the sale is firm and definitive. The Product must be returned in its original packaging, in its original condition, new, unworn, unwashed. Personalized products cannot be taken back or exchanged.
Reimbursement occurs subject to IBZ being able to recover the Products initially delivered. Unless the Customer wishes otherwise, IBZ makes the refund using the same means of payment as the one used for the transaction.
The return of the Products is the responsibility of the Customer. In the event of loss or deterioration of the returned package, we will not be able to refund the order and the buyer must make a complaint directly to his carrier.
The return costs are however borne by Lesfilsdisa if the Product delivered to the Customer is different from the Product ordered or if it is delivered damaged.
If the Customer fails to comply with these T&Cs, IBZ will not be able to reimburse the Products concerned.
– Guarantees – Limitation of liability:
Our policy lasts 14 days. If more than 14 days have passed since your receipt, unfortunately we cannot offer refunds or exchanges.
To be eligible for a return, your non-personalized item must be complete, unused, and in original new condition. We also advise you to use its original packaging.
Once your return has been received and inspected, we will email you to let you know that we have received the returned item. We will also let you know if your refund is approved or declined.
If approved, your refund is then processed and your credit card or initial means of payment is automatically credited within a few days depending on the banking establishment and you will be informed by email at the address provided. on the site at the time of your purchase.

The shipping costs associated with returning your item are your responsibility. They are not refundable. It is up to you to choose a tracked shipping service or to insure your shipment according to its value, which will circulate under your responsibility until it is received by Lesfilsdisa.
In accordance with Articles L.616-1 and R.616-1 of the Consumer Code, our company has set up a consumer mediation system. The chosen mediation entity is: CNPM - MEDIATION - CONSUMPTION. - Visible defect:
The presence of an apparent defect on a Product must give rise to a complaint by e-mail to the address: firstname.lastname@example.org within three working days of Delivery. Any complaint must explain the defect concerned. Otherwise, no complaint is admissible, and no return or exchange is possible. The Product must be returned, in its original packaging, in its original condition, new, unworn, unwashed, with the references of the initial Order and a copy of the complaint after sending an e-mail indicating the apparent defect of the Product referred to above. The cases of apparent defect confirmed by IBZ give rise, depending on the content of the Customer's complaint, either to the establishment of a credit note for the benefit of the Customer, or to the replacement of the Product, or to the pure and simple reimbursement of the Price to the Customer within a 14 day period. In case of non-compliance with the return procedure, no exchange or refund or credit is possible.
-Non-compliance - Hidden defects:
Subject to the validation of a non-conformity or a hidden defect by IBZ or the manufacturer as the case may be, the Customer benefits from the following guarantees:
– the legal guarantee of conformity which allows him to obtain, within two years of delivery of the Product and free of charge, the repair or replacement of the latter if it does not comply with the Order. This guarantee covers defects in the conformity of the Product and the packaging. IBZ may replace the non-compliant Product. If replacement is impossible within one month of the complaint or if the Customer issues a reasoned request, the Customer may request reimbursement of the price of the Product.
– the legal guarantee against hidden defects, under which the Customer may request, within two years from the discovery of the defect, the reimbursement of a Product which has proved unsuitable for its use.
The guarantee against hidden defects allows the Customer to be protected against hidden defects of the Product purchased and which prevent its use or affect it to such an extent that the Customer would not have purchased it. The Customer then has the choice between two options: keep the Product and request a price reduction, or return the Product and request a refund of the price paid.
In order to implement these guarantees, the Product must be returned, in its original packaging, in its original condition, new, unworn, unwashed, using the references of the initial Order and copy of the complaint to IBZ, after sending an e-mail email@example.com indicating the reason for the return of the Product.
For all practical purposes, the following legal provisions are recalled:
Art. L. 211-4 of the Consumer Code: “The seller is required to deliver goods that comply with the contract and is liable for any lack of conformity existing at the time of delivery. He is also liable for any lack of conformity resulting from the packaging, the assembly instructions or the installation when this has been charged to him by the contract or has been carried out under his responsibility. »
Art. L. 211-5 of the Consumer Code: "To comply with the contract, the good must: 1° Be suitable for the use usually expected of a similar good and, where applicable: a) correspond to the description given by the seller and possess the qualities that the latter has presented to the Customer in the form of a sample or model; b) present the qualities that a Customer can legitimately expect given the public statements made by the seller, the producer or his representative, in particular in advertising or labelling. 2° Or present the characteristics defined by mutual agreement by the parties or be suitable for any special use sought by the customer, brought to the attention of the seller and which the latter has accepted. »
Art. L. 211-7 of the Consumer Code: “Faults of conformity which appear within six months of delivery of the goods are presumed to exist at the time of delivery, unless proven otherwise. The seller can challenge this presumption if it is not compatible with the nature of the goods or the lack of conformity invoked. »
Art. L. 211-7 of the Consumer Code: “If the repair and replacement of the goods are impossible, the buyer can return the goods and have the price refunded or keep the goods and have part of the price refunded. The same option is open to him:
1° If the solution requested, proposed or agreed pursuant to Article L. 211-9 cannot be implemented within one month following the buyer's complaint;
2° Or if this solution cannot be without major inconvenience for him given the nature of the property and the use he is looking for. However, the resolution of the sale cannot be pronounced if the lack of conformity is minor. »
Art. L.211-12. of the Consumer Code: “The action resulting from the lack of conformity is prescribed by two years from the delivery of the goods. »
Art. 1641 of the Civil Code: "The seller is bound by the guarantee on account of the hidden defects of the thing sold which render it unfit for the use for which it is intended, or which so diminish this use that the Customer would not have acquired, or would have given only a lesser price, if he had known them. »
Art. 1648 paragraph 1 of the Civil Code: “The action resulting from redhibitory defects must be brought by the purchaser within two years from the discovery of the defect. »
Any reproduction or use without authorization of the texts, comments and photographs used on the site www.lesfilsdisa.fr, are strictly prohibited.
